Arbitration

Arbitration is a streamlined dispute resolution process. It is similar to litigation in that there is a neutral party who decides the case (an arbitrator instead of a judge), and there is some limited discovery. However, often arbitration is designed to get a faster result with fewer costs. There are both benefits and drawbacks to arbitration, but much like litigation, it is a process where your attorney will present a case to be weighed by the decision maker.

 

Arbitration clauses in contracts are not uncommon, and often arbitration is required before litigation can be filed. Arbitration can be binding (the result is final, absent an appeal of error), or non-binding (used most often to find out the likely result of litigation in more complex cases before all of the cost and effort are expended on litigation. This often results in a negotiated settlement after a non-binding award.)
